Types of Personal Injury

There are several types of personal injury cases that can arise, and many would not be considered as such by the average person. Most people think of slip-and-falls or pure negligence that causes actual physical injury to a person in these scenarios, but it goes much further than that.

Below are a few different examples of types of personal injury:

  1. Bodily Injury - This would be the "classic" personal injury case, where a plaintiff has suffered injuries to his or her brain, spine, skeletal system, organs or even suffered from a disease as a result of someone else's legally unreasonable conduct. Damages in these situations are usually quite straightforward in terms of proving pain and suffering, and the plaintiff's ultimate recovery could depend on the severity of the injuries suffered.
  2. Economic Injury - Certain acts can lead to damages that are purely economic in nature, and in these cases the plaintiff doesn't actually suffer physical injury. For instance, if someone's negligence leads to devalued personal property that's significant, this situation would be considered an economic injury, even though the analysis for almost every personal injury case would be the same.
  3. Injury to Reputation - This is the area of personal injury law where cases such as slander and libel claims would be classified. Some would consider these economic injury cases, but the inherent breach of the legal duty present is different, and the plaintiff needs to show actual harm to his or her reputation and that this harm has led to actual physical or economic damages in order for a claim to be sustained.
  4. Intentional Injury - This is an area of personal injury law where the negligence standard doesn't necessarily apply, as the defendant has done something that was either done with intent or was so grossly negligent that intent could be assumed. Examples of claims under this classification would be assault and battery.
