  3. Causation - If there was a duty and it was breached, liability will only attach to the defendant if the defendant's breach of said either proximately or in fact caused the injury to occur. This is the most complicated element within this analysis.
  4. Damages - A plaintiff must show tangible damages in order to be eligible for equitable recovery. Damages can be incurred in several ways.

The elements presented above are extremely brief. Each of the four elements discussed exists with thousands of judicial and legislative decisions behind it, and each element carries significant weight in terms of proof of liability.
